School takeovers

In the May 2017 issue of our newsletter we began to flag the issue that our members operating on school premises had been experiencing schools attempting to take over their clubs by refusing to renew leases and then setting up their own wraparound clubs instead. We feared that this would be a likely consequence of the budget cuts that many schools are facing. Now, in 2023, this is the number one worry for many providers operating on school sites. In this updated article we explore some defences to this situation that clubs can use with thanks to Jodie Seddon from Aria Grace Law CIC for her invaluable input on the legal position. 

For most schools this is a purely pragmatic solution to a desperate funding situation that has only been getting worse over recent years, but for private providers it is depriving them of not only a business that they may have worked for many years to build up, but also their livelihood. We do have some suggestions for strategies that you can use in order to protect your business.
